Hot Water Heater Safe Tray

Just had a new hot heater installed. The plumbers did not put the safe tray back under the new heater as they broke the existing one removing the old heater. Reading the manual supplied with the new system, it states that "It is a requirement of the National Plumbing Code AS3500.4 that for new installations all hot water heated be installed with a safe tray ..."
I have contacted the supplier of the HWH and they stated that it is not necessary becuse the HWH was installed in the garage and will not be a problem.
Have the plumbers not conformed to the Aust Standards? Is this a problem? If yes, what can I do about it?
